Associate General Counsel – Marketing, Consumer Law & Privacy

This is a highly rewarding position for attorneys who are commercially minded, solution-seeking and thrive on communication with business leads. This position is exposed to a variety of unique business transactions and works closely with various Carnival Corporation departments, as well as the relevant departments at each operating company, to provide timely and effective legal counsel. This position mostly works under moderate supervision and the individual in this role must be comfortable making decisions on contractual provisions, risks, deal structuring and negotiations as well as provide sound legal advice to business teams on various consumer marketing and data privacy related matters. The individual in this role must be efficient, responsive, organized and capable of managing multiple projects at the same time. The objective of this position is to serve as an attorney in the Carnival Corporation Global Legal Services Department. Primary responsibilities focus on the review, drafting, and negotiation of contractual agreements, the review of marketing materials, and the review and drafting of disclaimers, terms and conditions, and contest, sweepstakes, and promotion rules on behalf of Carnival Corporation and its affiliated companies, as well as advising the business on state and federal consumer and advertising laws, and FTC guidelines. Additionally, this position will focus on the review, drafting, and negotiation of data privacy-related contractual provisions and policies as well as the provision of advice to the business on its legal responsibilities regarding compliance with state, national and international privacy laws and data security. 

Essential Functions:

  • Provide legal support in drafting, reviewing and negotiating various contractual agreements, including marketing agency agreements, co-marketing agreements, promotion agreements, data acquisition agreements, and other commercial agreements from other departments within the company, as directed by the Sr. Assistant General Counsel. 
  • Provide legal advice and support on state, federal, and international consumer and advertising laws, data privacy laws, FTC guidelines, marketing materials, offers, disclaimers, claim substantiation, terms and conditions, promotions, sweepstakes, contests, marketing initiatives and activations.
  • Providing advice on data privacy laws and the review and negotiation of data privacy related contractual provisions.

Qualifications:

  • Minimum Education: J.D. Degree, preferred education J.D. degree from an accredited law school.
  • Required Certifications: Good standing with any State Bar; CIPP
  • Required Years and Area of Professional Experience: 3 years relevant experience with a major law firm and/or as in-house counsel with experience in commercial transactions.
  • Critical Professional Related Technical/Computer Skills: Highly proficient technical skills in MS Office Suite.
  • Other Requirements: Work beyond normal business hours is required occasionally to support business needs or projects. Team player who can also work independently and thrives in a fast-paced environment.
  • Preferred Experience and Type: Experience in hospitality, travel and/or intellectual property a plus. CIPP Certification

  • Ability to work efficiently and handle multiple high priority matters at any given time. 
  • Excellent interpersonal communications skills (written and verbal) required.

  • An ability to balance legal risk with business needs.

Decision-Making:

  • Tactical: Decisions focus on intermediate-term issues. The purpose of decisions made at this level are to help move CCL closer to reaching strategic goals. Outcomes are predictable. After a decision is made by Top Executive Leadership, the next phase is to take the needed steps to implement it. Examples are: The amount of money required to implement, which advertising agency to promote a new service or to provide an incentive plan to employees to encourage increased revenue.
  • Operational: Decisions focus on day-to-day activities within the company. Decisions made at this level help to ensure that daily activities proceed smoothly and therefore help to move the company toward reaching a strategic goal. They have short term consequences. Examples are: Handling employee conflicts, purchasing materials needed for operations.
  • Standard: These decisions are those that are repetitive decisions on a recurring basis and are commonly related to daily activities. They are relatively simple, relying on historical data and previous solutions. Examples are: reordering of standard office supplies, handling transactions. 

Physical Demands: Must be able to remain in a stationary position at a desk and/or computer for extended periods of time. Requires regular movement throughout CCL facilities.

Travel: Less than 25% non-shipboard travel likely

Work Conditions: Work primarily in a climate-controlled environment with minimal safety/health hazard potential. Other job specific working conditions Remote/Hybrid Work.

The range for this role’s salary rate is $120,000-$130,000. Offers to the selected candidates will be made on a fair and equitable basis, taking into account specific job-related skills and experience.
