This position is responsible for the continued development and maintenance of Garrett’s EMEA import-export compliance program. The Trade Compliance Senior Manager will provide leadership and expertise in ensuring EMEA trade compliance for Garrett.

This role has direct responsibility for overseeing EMEA import and export, ensuring compliance with EU import and export laws, as well as free trade and duties eligibility for various programs, providing a full coverage of Company's reputation against penalties associated with non-compliance: sanctions, fines, loss of import or export privileges, disruptions on deliveries to customers and plants. 

The EMEA Trade Compliance Senior Manager works cross functionally with business and operations leaders to broaden awareness of trade compliance, establishing and maintaining the strategic direction of the function in alignment with the changing regulatory environment. This is accomplished by interfacing directly with the various import-export compliance personnel and functional area leaders to drive process improvements implementation in all areas of import-export compliance.

Covering all the trade activities in United Kingdom, Ireland, France, Slovenia, Slovakia, Romania and Czech republic with a total import & export value of $1.2 billion, this position manages a $30M duty cost budget both duty payable and duty savings & avoidances and supervising various duty incentive programs.

Position is responsible to lead all customs audits that may be triggered in the whole European region, and for monitoring key industry developments, legislative, and regulatory changes affecting Garrett. Position leads with business management and other functional area managers to investigate possible customs compliance violations.

Position will report to the Global Trade Compliance Senior Director, and interface with Garrett business management, customs brokers, freight forwarders, internal/external legal counsel, customers, suppliers, Customs Authorities and government officials.

Position will also provide supervisory support, training, mentoring, to EU import-export compliance personnel and will also assist Supply Chain functions with all departmental goals and objectives.

  • Responsible for Trade Compliance in Europe
  • Conduct Customs compliance on site review/self-assessment, write audit reports including compliance improvement plan and support sites with implementation;
  • Responsible for import /export Clearance Cycle Time and other Compliance KPI for the region 
  • Report to Global Trade Steering Committee members (SC Director, VP ISC, CFO, ect ... ) Europe Metrics, new regulations, trend, risks, and opportunities
  • Manage brokers including Broker selection, contract, eauction, implement and supervise score card/KPI, contractual agreements and SOP;
  • Management of all import-export operations in the region;
  • Implement controls and supervise determination and maintenance of Country of origin, Classification and Valuation for components and turbochargers with Supply base and Sales administration;
  • Coordinate with various functional areas to minimize risks/maximize opportunities, including but not limited to Legal, Tax, Supply Chain, Supply Base, HS&E, Finance;
  • Support Global Trade Compliance function with on site reviews; 
  • Identify and support import duty savings;
  • Support landed cost analysis; 
  • Support Incoterms buy/sell decisions; 
  • Support cross functional projects (Sales, Supply Base, Supply Chain, and Finance) with duty impact analyses and winning opportunities in case of source changes or new Supply Chain flows;
  • Formal communication to customs authorities: customs request for information; ect ....
  • Verify import and export recordkeeping and conduct post entry audits of import and export records for all EU sites; 
  • Manage local broker(s) with focus on Commodity Codes. Monitor performance, address local service issues, ensure the development of standard operating procedures; ensure development and execution of entry audits and billing;
  • Classify EMEA part n° and Maintain EMEA customs classification in GTS;
  • Responsible for EU preference process and preference administration in GTS : preference management, issue Long Term Supplier Declarations for Swissco plants and customers; monitor compliance of preference calculation and process in GTS system, supervise Long Term Supplier Declarations for vendors and support Purchasing administration in annual dunning process and new vendor creation;
  • Lead Intrastat process improvement and implement post audits; 
  • Create and deliver import and export training to identified staff in EMEA ;
  • Deliver awareness session to Functional groups: Finance, Engineering, Supply Base, Tax, Logistics, Sales;
  • Act as in-house Export compliance expert within the region and provide consultation and risk assessment to Customer management team, Aftermarket, supply base, finance/Tax team in relation to dual use, military end user or end usage, EU sanctions. Proactively monitor and track EU sanction packages against Russia/Belarus and inform trade management team and global leadership team. Issue and update Export Control guidelines / policies as necessary. Perform Sanctions, denied party screenings in SAP GTS and resolve any “red alert” “hits” with further economic ownership investigations.
  • Oversee and assess export control risks on any new business flows, transactions, customers or business partners to ensure strict adherence to US/EU export control requirements.
  • Assign export tariff classification and assess corresponding dual use conditions on existing turbo products or machineries and any new growth verticals or innovative technologies.
  • Liaise with government agencies when required for export control rulings or export license application to ensure business continuity as well as compliance.
  • Deliver regular Export Control Trainings to key personnel in Customers management team, aftermarket, supply base and finance/Tax so cross functions are well kept informed on current export control regimes and regulatory requirements.
  • closely work with internal legal team and external law firms to take lead on any Customs audits/controls and litigations to safeguard the company's compliance credibility. 
  • Provide quarterly executive summary to internal general counsels on the progress of any audits and litigations so business impacts including P&L impact can be reported to the global leadership team in a timely manner and disclosed according to relevant regulatory requirements.
  • Responsible for P&L budgeting including STRAP, AOP, rolling financial forecasts as well as managing monthly financial closing to ensure alignment with company's P&L targets.
  • Identify and investigate root causes of any P&L target deviations and put in place corrective actions to ensure no further incremental P&L negative impacts.
  • Monitor and proactively track any regulatory policy changes. Assess business impact and inform global trade management team and relevant cross functional leaders in the region through quarterly trade steering committee and quarterly trade newsletters.
  • Work closely with internal government relation functional leader to take lead on engaging with EU commission/DG Trade to advocate on relevant policy changes so the company's business interests are well protected or business impact are well in advance anticipated and informed to the global leadership team.
  • Actively participate relevant trade associations including CLEPA ( EU auto parts trade associations) to benchmark business practices and provide inputs on any of the position papers in relation to any potential policy and regulatory changes.
