We are seeking a strategic and experienced Claims Programs Section Director to lead our claims team at the Texas Department of Transportation. Position Description
Manages the Department's self- Insurance Program for department employees. Supervises a group of professional and technical employees. Work requires contact with governmental agencies, medical and legal professionals and private entities. Employees at this level are virtually self-supervising and assume direct accountability for the work product.
Essential Duties:
- Acts as advisor to the division director regarding tort claims and lawsuits; makes recommendations for settlement of tort claims.
- Advises adjusters in preparation for more difficult claims dispute conferences and hearings and periodically attends with adjusters.
- Advises and assists the Office of the Attorney General in preparing defense positions for lawsuits, conferences, hearings, investigative files, subpoenas, interrogations and requests for information.
- Advises in matters regarding workers compensation and tort/liability claims.
- Advises the division director and section directors on matters related to the Workers' Compensation Act, self-insurance, tort claims, safety programs and hazardous materials.
- Conducts seminars and training sessions and makes presentations.
- Develops the Division budget and oversees the preparation of contracts to secure expert witness services.
- Monitors and reviews compensation cases to ensure accurate decisions and timely payments of indemnity and medical benefits.
- Monitors appeals panels and court decisions; writes summaries; assists in required updates to policies and procedures; advises and trains adjusters in application of these decisions to claims.
- Oversees branch activities to ensure compliance with state/federal laws and policies governing investigation, compensability determination, evaluation, benefit delivery, documentation and final disposition of worker's compensation claims.
- Prepares and administers contracts for vendor-provided services.
- Serves as point of contact for correspondence between the Department and the Texas Workers' Compensation Commission.
- Serves as the Department's official representative to the Texas Workers' Compensation Commission and attends Commissioners' meetings; consults with the Commission staff and attends compliance conferences and hearings.
- Travels to represent the Department at the most difficult claims dispute conferences and hearings.
- Performs other job responsibilities as assigned.
Minimum Qualifications:
Education:
- Bachelor's Degree in Business Administration, Risk Management, Insurance or related field.
- Relevant work experience may be substituted for degree on a year per year basis. Substitutions for Minimum Qualifications OR related graduate level education may be substituted for experience on a year per year basis.
Experience:
- 5 years of experience in claims adjusting or related claims activities.
- Experience can be satisfied by full-time or prorated part-time equivalent.
- Related graduate level education may be substituted for experience on a year per year basis.
- Must have one (1) year supervisory/managerial experience. Project leader or lead worker experience may substitute for supervisory/managerial experience.
Licenses and Certifications:
- Valid driver’s license. This position requires driving a state vehicle.
Must have current certification in one of the following professional licenses or certifications:
- Texas Claims Adjuster-Worker Comp
- Texas Claims Adjuster-All Lines
