Description

The Kentucky Real Estate Authority is seeking a Staff Attorney III to join our team of highly skilled professionals. In this role, you will collaborate with General Counsel and the legal team to draft administrative regulations for four different real property boards, process and facilitate the adjudication of administrative complaints, and provide legal support and guidance for all four real property boards. This position will also draft and review pleadings, orders, subpoenas, and other legal documents for legal sufficiency, and engage in other legal duties as assigned.

Candidates can expect typical state employee work schedules (Monday-Friday 8:00 a.m. – 4:30 p.m.) and the possibility of limited travel to attend court functions (hearings, trial, and other adjudicatory matters) and industry events.

Responsibilities include, but are not limited to:

• Advising the four real property boards regarding disposition of consumer complaints and other complex legal matters by researching and becoming thoroughly familiar with routine, as well as specialty areas of the law.
• Serving as the primary point of contact for specific real property boards overseen by the Kentucky Real Estate Authority as assigned by its General Counsel
• Drafting, reviewing, commenting, and filing proposed legislation and/or administrative regulations as directed including amendments.
• Negotiating settlement agreements and conducting administrative hearings.
• Preparing documents for administrative hearings and circuit court actions.
• Assisting with open records requests and appeals.
• Performing other duties as assigned.

Minimum Requirements

EDUCATION: See Special Requirements.

EXPERIENCE, TRAINING, OR SKILLS: Must have two years experience as a licensed attorney in the practice of law.

Substitute EDUCATION for EXPERIENCE: A Master of Laws degree (LL.M.) will substitute for one year of the required experience.

Substitute EXPERIENCE for EDUCATION: NONE

SPECIAL REQUIREMENTS (AGE, LICENSURE, REGULATION, ETC.): Must be admitted to practice law and in good standing in the Commonwealth of Kentucky OR comply with Kentucky Supreme Court Rule (SCR) 2.111 (limited certification of admission to practice), SCR 2.112 (attorney participants in defender or legal services programs), SCR 2.117 (practice pending admission). Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s), or other credentials.

Working Conditions

Duties are performed primarily in both office and courtroom settings. Travel is required.

Probationary Period

This job has an initial and promotional probationary period of 6 months, except as provided in KRS 18A.111.
