Civil Rights Division First Chair Position (Prosecutor V)

Summary

This position leads the Civil Rights Division (CRD), which is now included within the Public Integrity and Civil Rights Division. Duties include the review, evaluation and assessment of all Officer Involved Shootings (OIS), custodial deaths, and official actions that could reasonably result in potential prosecution of excessive use of force*. This analysis requires the application of all relevant Texas statutes and case law precedent. The results of said analysis are presented to the elected District Attorney for charging guidance/decisions. The person selected will be subsequently responsible for all resulting criminal prosecutions. Additional duties include the requirement to be on call 24 hours a day to visit the scene of any officer involved shootings as well as leading the CRD team, which includes a felony prosecutor, investigator, and advocate.

  • Includes the use of deadly force, physical force, or deaths of citizens in custody, and force used in State Facilities.

Duties and Responsibilities

  • Supervises the preparation of and prosecutes the most complex criminal, high profile or media interest felony and drug cases for trial or appeal
  • Represents the State of Texas in criminal, juvenile or civil cases before judges and juries and litigates appeals
  • Advises less experienced prosecutors on case strategies, evidentiary strength assessment, and legal research information
  • Contacts and/or interviews victims, witnesses, defense attorneys, investigators, experts in specialized fields, and law enforcement personnel regarding restitution, plea bargains, punishment issues, and to prepare for trial
  • Researches statutes and case law issues and performs computer assisted research regarding criminal histories and case status
  • Organizes pre-hearing and trial dockets requiring witness appearance coordination and negotiating plea bargains
  • Uses basic and advance software and programs utilized to manage caseloads and related information
  • Dictates, edits, and updates legal documents prepared by the clerical and paralegal staff
  • Maintains responsibility for discovery compliance
  • Prepares case disposition statistics and reporting data
  • Supervises, trains, and evaluates Prosecutor IV’s, III’s, and Misdemeanor Prosecutors, Paralegals, Advocates, Interns, and office support staff when required
  • If assigned to the Department of Family and Protective Services (DFPS) Division: prepares and prosecutors child protection cases; reviews requests for removals and other legal actions, including after hours; and prepares DFPS related Continuing Legal Education (CLE) Trainings
  • Performs related duties as required

Minimum Qualifications

  • Graduation from an accredited college or university with a Doctorate of Jurisprudence and six (6) years prosecution experience, or an equivalent combination of education and experience; and must be licensed to practice law in the State of Texas.
  • Comprehensive knowledge of criminal prosecution procedures or civil procedures and techniques; good knowledge of investigatory methods; good knowledge of criminal/victim psychological and behavioral profiles; ability to maintain the highest ethical and professional standards expected of an attorney and related prosecution team members representing the State of Texas.
  • Skill in organization and presentation of facts and supporting logic; skill to ascertain factual information from conflicting or purposely inaccurate data; skill to communicate professionally and effectively with hostile, abusive or irrational individuals in routine and highly stressful situations; skill to communicate professionally and effectively, both verbally and in writing.
  • Ability to supervise employees to create and maintain an effective team environment; ability to establish and maintain professional effective working relationships with co-workers, County employees, attorneys, law enforcement officers, DFPS staff, the news media, and the public in routine and highly stressful situations; ability to develop effective and persuasive oral and written advocacy skills and assist others in achieving the same; ability to operate personal computers and basic office equipment, develop proficiency in basic and advanced software and programs utilized to manage caseloads and related information.
  • Must have valid Texas driver’s license, motor vehicle liability insurance and personal injury insurance; or have a self-reliant source of transportation to conduct business daily.
  • Must secure and maintain a favorable background investigation and clearance.
  • Must clear a pre-employment physical
  • Required to be on-call 24-hours a day.
  • May be required to work more than 40 hours during the workweek.
