Main Responsibilities
Contract Management Process Optimization
- Sustain and enhance contract management competence in Project Procurement APAC to secure Covestro CAPEX target of building faster and cheaper.
- Continuously optimize contract management process based on lessons learnt and best practice from projects, rollout advanced management concepts and methods to all related projects via information-based tools to improve contract management efficiency and effectiveness.
- Develop and maintain templates related to contract management and enable proper usage in all related projects via regular training. Centrally organize legal templates related to project execution models and service procurement, conducting regular update and necessary adjustments to enable proper contract execution for projects.
- Develop and maintain contractor database for services needed by projects in APAC, regularly review and collect contractor performance evaluation/feedback from each project to support contractor database update, guide and support new contractor pre-qualification process.
- Enable synergies and knowledge sharing for contract management work across APAC projects via standard process, templates and trainings.
Support Contract Management for project
- Enable right selection and implementation of suitable contracting strategies and best practices for each project to safeguard project objectives.
- Review service contracts for projects, including but not limited to Engineering Service contract, EPC, EPCm, Construction contracts, and Frame Agreement, to ensure contract legal and compliant. Identify potential risks in contracts to provide risk prevention and mitigation advice and work together with project and legal to develop counter measurements to secure contract execution.
- Support essential ITB packages(EPC, EPCm, etc.) bidding, negotiations, change & claim settlement, and dispute resolution, etc.
- Monitor contract performance for projects, keeping close communication with Contract Manager assigned to each project, providing timely guidance and support to enable an effective contract claim prevention and change management process.
- Support mega project execution
Team Management and Collaboration
- People manager of contract management team, including staffing plan, recruitment, people development, training, performance appraisal, etc..
- Stakeholder management within company, including ENG APAC, Project team, legal, and finance, etc., ensure efficient and collaborative execution process for projects.
AI Application and Value Creation
- Use AI technology to improve efficiency and quality of tender evaluation work, including BOQ evaluation, tender report and contract T&C comparison.
- Track, review and analysis claim and change result for each project to figure out area for continuous improvement.
- Data collection and analysis to establish benchmark for various type of services
Work Relations: Internal & External Cooperation and Relationship Maintenance
Internal:
- Covestro ENG APAC: Project Managers, Construction Managers, Group Lead, Project Lead Engineers – align on project contract strategies, ITB requirements, vendor pre-Q, contract post-award management, training
- Covestro Procurement: Head of CI Procurement APAC, Contract Managers, Project Procurement Managers – Report, support and alignment
- Community: ENG Global Claim Prevention and Change Management, CIP Global – Knowledge sharing
- Covestro LIPC and CFO: Legal, Insurance, Finance – Alignment and joint development of contract templates, negotiation support.
External:
Main contractors: evaluation, negotiation, cooperation.
4. Job Qualifications
Educational Background
- Bachelor's degree or above, in technical or legal major preferred (law, mechanical engineering, civil engineering, or equivalent)
Work Experience
- Minimum 15 years of working experience in contract management/construction supervision, with leadership responsibilities
- Good knowledge in EPC and EPCm strategy setup, bidding and contract management process, rich experience working with both international and local contractors
- Skillful in contract drafting, review, and negotiation, good business sense to use accurate contract terms to protect company's interests effectively
- Proficient in data analysis
Competencies and Qualities
- Good communication and leadership to enable high performance team.
- Integrity and accountable team player with good ethics and confidentiality awareness
- Self-motivated for problem-solving and continues improvement to strive for value creation to project
- Familiar with Contract Law, FIDIC terms and conditions, and Rules of International Arbitration
- Good computer knowledge (Excel, PowerPoint)
- Excellent English proficiency (written and spoken)
