Description:

We are seeking Principal Counsel, Global Patent Litigation to join either our Bridgewater, NJ or Cambridge, MA office. The Principal Counsel, Global Patent Litigation will be responsible for managing enforcement of the company’s patent rights and defense against patent infringement suits throughout the world. The role will also manage patent office proceedings (both pre-grant and post-grant) in the United States, Europe, Asia, and throughout the world. The role will report directly to the Global Head of Patent Litigation.

Main Responsibilities:

  • Advocate for the company’s position in global patent enforcement actions
  • Manage ANDA, 505(b)(2), BPCIA and other patent litigations, including post-grant patent office and international invalidation and strategic opposition proceedings
  • Assist in securing freedom-to-operate for the company’s products
  • Examine and explain complex scientific and legal concepts
  • Develop strategies for patent enforcement matters that align with the company’s business objectives
  • Coordinate substantive positions among the company’s global patent litigations
  • Present strategies and updates to internal stakeholders (including senior management)
  • Establish and maintain good working relationships with outside counsel while evaluating their advice independently
  • Partnering with the company’s employees and our strategic alliance partners on patent enforcement matters

Requirements:

  • A Juris Doctor from a recognized, accredited law school is required
  • A minimum of 12 years of patent litigation experience in the life sciences area is required
  • Active membership and good standing in NJ, MA, or other state bar
  • A scientific background in the biological sciences, chemistry, or engineering is required
  • Current or prior Law firm experience is required
  • This position may require po to 10% overall business travel

Preferred Qualifications:

  • BPCIA and Hatch-Waxman patent litigation experience 
  • Experience handling both biologic and synthetic molecule (small molecule) patent litigation matters
  • Registration with the U.S. Patent and Trademark Office
  • Experience with patent office proceedings, and familiarity with international invalidation and opposition proceedings
  • Experience as in-house counsel patent litigation counsel at a pharmaceutical/biotech company
