POSITION DETAILS

The Executive Legal Counsel/Chief Legal Affairs & Labor Relations Officer reports directly to the President and provides legal advice on a broad array of issues, including, but not limited to: litigation, employment and labor law, compliance, contractual agreements, governance, and oversight of the search process, affirmative action plans, training, and workplace investigations. The selected candidate will possess a record of professional experience that demonstrates progressive responsibilities and significant interaction with senior leadership teams. Experience in higher education is strongly preferred, as is experience serving in a prominent leadership role, managing direct reports and working effectively with various constituencies.

The Executive Legal Counsel also serves as hearing officer for disciplinary and grievance proceedings and represents the College at higher levels of the disciplinary and grievance processes as the Labor Relations Designee. The Executive Legal Counsel serves as the College’s liaison to the University’s Office of Legal Affairs, and coordinates Ethics Officer and Records Access Officer responsibilities. The Executive Legal Counsel provides legal advice and consultation to the President, administration, and faculty through administrative channels.

With respect to the college’s search processes, the Executive Legal Counsel supervises the certification that search committees meet diversity requirements and that they are informed of all City University of New York (CUNY) search procedures and policies. In coordination with the College’s Office of Human Resource Services and Office of Academic Affairs, the Executive Legal Counsel supervises the development and revision of training programs for staff, faculty, and students on a range of topics, including, but not limited to: diversity, equity and inclusion in the workplace; affirmative action compliance; implicit bias; ethics; conflict resolution; bullying and other forms of misconduct; and workplace violence. The Executive Legal Counsel also serves as the college’s liaison to the City University of New York (CUNY) Office of Diversity and supervises the preparation and submission of periodic plans and reports to the University, the CUNY Board of Trustees, the State, the City, and other relevant entities.

Responsibilities include, but are not limited to, the following:

  • Reviews and recommends institutional policies, procedures, guidelines, and other documents as needed. Assesses potential legal exposure and concerns brought to the attention of the College’s senior leadership.
  • Provide guidance and support in the development and implementation of College policies and the implementation of and compliance with University policies, such as the Academic Integrity Policy, Procedures for Handling Student Complaints about Faculty Conduct in an Academic Setting, the Grade Appeals Policy, Intellectual Property Policy, the Sexual Harassment Policy, etc.
  • Serve as the College’s Legal Counsel and Labor Relations Designee. Represent the College at Step One grievance and disciplinary hearings. Investigate, write, and issue Step One grievance and disciplinary decisions. Investigate, prepare case material for, and represent the College at subsequent grievance and disciplinary hearings.
  • Assist the CUNY Office of the General Counsel and Office of Human Resources Management and act as the College's representative at arbitration.
  • Investigates complaints filed from outside agencies; provides records, files, and documents required at legal inquiries and proceedings; prepares and reviews contracts and affiliation agreements entered into by the College; assists in proceedings before federal and state courts and administrative agencies; and ensures College compliance with federal, state, and local laws and regulations.
  • Ensures compliance with promotional and tenure standards promulgated by the City University of New York.
  • Oversee the presidential appeals process for faculty and other members of the instructional staff who have been non-reappointed or denied tenure or promotion, including, without limitation, advising the President, drafting all appeal-related correspondence and the President's letters of reasons.
  • Represent the College in student disciplinary cases and provide guidance to the Vice President for Student Affairs on a range of issues, including student election matters, student government issues, employment contacts, and commercial contracts.
  • Conduct training on various issues in collaboration with other units within the College.
  • Supervises the development of effective strategies to promote diversity in faculty and staff and build strong networks and recruitment;
  • Supervises the implementation of the CUNY Affirmative Action Policy and the creation, revision, and excellence of diversity training designed to foster a climate that encourages respect for diversity, equity and inclusion and other forms of compliance-related training.
  • Supervises the charging of search committees in the implementation of Affirmative Action program regulations and departmental affirmative action plans, and related responsibilities.
  • Oversees employment search process for faculty and staff positions to include reviewing the composition of search committees, conducting search charges, recommending ad placements, and approving the applicant pool. ensures adherence to University Bylaws and federal and state laws pertaining to equal employment opportunity and affirmative action.
  • Oversees the investigation of complaints asserted under Title VI, VII, IX, Section 504, federal and local disability law, CUNY policy, and any law that prohibits discrimination based on a protected status.
  • In coordination with Office of Human Resource Services and/or the Office of Academic Affairs, supervises the investigation of complaints concerning a range of matters including, but not limited to: discrimination, workplace violence, workplace misconduct and bullying, incompetent or inefficient service, neglect of duty, and conduct unbecoming a member of the staff.
  • Supervise and develop staff.
  • Performs other related duties as assigned by the President.

QUALIFICATIONS

This position is in CUNY's Executive Compensation Plan. All executive positions require a minimum of a Bachelor's degree and eight years' related experience.

Other Qualifications

Candidates must have a JD, be admitted to the N.Y. State Bar, and have at least eight years of related experience including experience in the field of employment law. The successful candidate will have excellent communication, interpersonal, conflict resolution, and organizational skills, as well as excellent judgment. Prior experience in working in a college or university setting.

COMPENSATION AND BENEFITS

$180,000 - $195,000; Salary commensurate with education and experience.
