The Opportunity

The ACLU of Northern California (ACLU NorCal) is hiring a Staff Attorney to join its Technology and Civil Liberties Program. The Staff Attorney will help build and expand the cutting-edge legal and policy work of the Technology and Civil Liberties team —one of six broad issue-based programs in the affiliate’s Legal-Policy Department. This is an exciting opportunity to provide vision and support to a program nationally recognized for its leadership in defending civil liberties and civil rights and promoting social justice in the digital age.

The Staff Attorney will be supervised by the Technology and Civil Liberties Director. The position can be based in ACLU NorCal’s San Francisco, Sacramento, or Fresno offices.

Our work is guided by the principles of freedom, equality, and justice enumerated in the Constitution. However, we know that because of historic and systemic racism and other forms of oppression, these principles are not equitably applied to all. The Position

You will use your legal experience, creativity, and collaborative approach to develop and lead integrated legal advocacy work in the courts, communities, with companies, and with policymakers, to defend and promote civil rights and civil liberties in the digital age, maximize impact, and support systemic change in both the government and private sector. You will build on the inalienable constitutional rights guaranteed to all Californians to safeguard and promote privacy, free expression and other rights for people in this state and far beyond. You will uncover and stop dangerous government surveillance and build real public safety. You will empower people to have meaningful choices about how and when they use technology and to ensure that they can control how their personal information is collected, shared, and used. You will work with diverse partners across social movements to build a world where technology is working for a just and equitable society.

This position is eligible for telecommuting.

About the Organization

The ACLU of Northern California is an affiliate of the American Civil Liberties Union a nationwide, non-profit, non-partisan organization dedicated to the defense and expansion of civil liberties and civil rights. The ACLU of Northern California (ACLU NorCal) is comprised of two distinct corporations, the ACLU Foundation of Northern California (501c3) and the ACLU of Northern California (501c4). The incumbent is a joint employee of both corporations. COVID-19 Prevention

Due to COVID19 shelter in place restrictions this position will be temporarily based from your home office in California. The ACLU NorCal physical offices are expected to re-open in October and at this time we are beginning to transition back to in person work from our regional offices.

Duties & Responsibilities

  • Engage in the investigation, development, initiation, and litigation of high-impact cases, which could include: managing fact and expert discovery; conducting legal research and analysis; drafting pleadings, motions, briefs and complaints; evaluating and investigating potentials claims; identifying potential plaintiffs, issuing public records requests; and coordinating amicus briefing. (35%)
  • Engage in legal-policy advocacy at the local, state, and national level, which could include: conducting legal research; developing policy models; drafting advocacy letters; providing expertise to policymakers; and drafting reports and other public education materials to both demonstrate the need for policy change and facilitate policy implementation. (35%)
  • Forge and maintain relationships with community members, coalition groups, experts, government officials, and academics to engage them in our work and implement collaborative projects. (20%)
  • Participate in team, department, and other meetings; help to set a collaborative, inclusive culture for the Technology and Civil Liberties team; engage with colleagues at other ACLU affiliates and National ACLU as well as with external partners. (10%)

Qualifications

Education / Experience:

  • D. from an ABA-accredited law school.
  • Membership in the California State Bar. If you are currently a member of another state bar, you must sit for the next available California Bar Examination and pass the California Bar Examination within 12 months of joining the organization.
  • 2 or more years of litigation and/or policy experience, preferably related to the technology and civil liberties field.

Required Skills / Competencies:

  • Interest and understanding of technology and civil liberties work.
  • Experience engaging in the investigation, development, initiation and litigation of high-impact cases and/or experience with the development and implementation of policy advocacy on the local, state or national level.
  • Strong legal research, analysis, and writing abilities, and ability to craft novel and successful legal and policy strategies in response to inequitable systems.
  • Ability to effectively communicate, through both writing and public speaking, to various audiences about complex legal and technical issues.
  • Demonstrated initiative and creative problem-solving.
  • Strong project and time management skills, including a high level of organization, attention to detail, and follow-through, while balancing and prioritizing multiple activities and responsibilities.
  • Relationship-building skills and willingness to work as part of a team, and to be an engaged, proactive member of internal cohorts, as well as outside coalitions on which you work and interact. 
  • Commitment to diversity and demonstrated ability to hold and foster difficult and necessary conversations about race, class, sexual orientation, gender identity and expression, religion, ability, and other identity-based issues.
  • Commitment to incorporating racial equity principles into all aspects of work.

Preferred Skills / Competencies:

  • Intersectional analysis and the ability to contextualize technology and civil liberties issues within other social justice movements.
  • Direct personal or professional experience with impacted communities and/or with grassroots and community-based organizations

Technical Skills:

  • Working knowledge of Microsoft Word, Outlook, Adobe Acrobat, PowerPoint, Excel and other Office programs.

Total Compensation

We are committed to creating and maintaining a diverse workforce through equity initiatives, which includes equitable pay apractices. Competitive compensation is commensurate with experience. Starting salary range for this position is $89,294.57 to $200,912.79
