Executive Office for Administration and Finance

The Executive Office for Administration and Finance, Commonwealth of Massachusetts, is seeking applicants for the position of Deputy General Counsel.

The activities of the Executive Office for Administration and Finance (“A&F”) fall within five broad categories: (i) administrative and fiscal supervision, including supervision of the implementation of the Commonwealth’s operating budget and capital investment plan, and monitoring of all agency expenditures during the fiscal year; (ii) enforcement of the Commonwealth’s tax laws and collection of tax revenues through the Department of Revenue; (iii) human resource management, including administration of the state personnel system, civil service system and employee benefit programs, and negotiation of collective bargaining agreements with certain of the Commonwealth’s public employee unions; (iv) capital facilities management, including coordinating and overseeing the construction, management and leasing of all state facilities; and (v) administration of general services, including state procurement. The Secretary of Administration and Finance serves on numerous state boards and commissions.

The Office of the A&F General Counsel deals with a broad range of complex issues for A&F and protects the legal interests of the Secretariat and the constituent A&F agencies while working to advance the Secretary’s initiatives and policies in cooperation with the constituent agencies, the Office of the Governor’s Legal Counsel, and numerous other agencies. The Deputy General Counsel of A&F assists the A&F General Counsel in advising the Secretary and others within A&F and its constituent agencies on myriad legal issues affecting the Executive Office and those agencies, as well as on the development, review and implementation of legislation, litigation, and policy matters within and among the constituent agencies. The Deputy General Counsel assists the General Counsel in their interactions with and responsibilities to the A&F constituent agencies’ general counsels, A&F staff, the Governor’s Legal Office, other Secretariats and the Attorney General’s Office, legislative committees and others. The Deputy General Counsel also helps to ensure consistency and communication across A&F and its constituent agencies.

MAJOR RESPONSIBILITY AREAS (as assigned by the General Counsel):

  • Review regulations submitted to the Executive Office for review and approval by other Executive Offices.
  • Analyze proposed legislation in connection with the Commonwealth’s operating budget and capital investment plan, including other branches’ legislative proposals with respect to the operating budget.
  • Provide legal advice to the General Counsel on policy development, public records and records retention.
  • Research, develop and draft legislation for General Counsel/Secretariat review and interpret the effect of such legislation.
  • Coordinate the legal activities of the Department with the General Counsel and, when appropriate, with the Legal Counsel of other departments.
  • Serve as a representative of A&F in meetings, conferences, advisory committees, and other events where the secretariat’s presence is appropriate.
  • Review draft contracts to which A&F or A&F agencies may be a party.

Required Qualifications:

  • Member in good standing of the Massachusetts Bar.
  • Excellent legal research and writing skills and strong interpersonal skills.
  • Creativity in approaching problems and reaching solutions, attention to detail, the ability to juggle a wide variety of issues and assignments simultaneously, and responsiveness to the many issues and concerns that arise on a daily basis, while maintaining composure and a helpful attitude.
  • The ability to work independently on discrete issues while effectively communicating about those issues and workload.

Preferred Qualifications:

  • Familiarity with state finance law governing the Commonwealth, such as procurement and contracting and bond issuances.
  • Familiarity with state tax law and policy.
  • Familiarity or experience working in or with the state legislature.
  • Experience with the Commonwealth’s public records law.
  • Prior experience working in or with state government.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS:

Applicants must have at least (A) seven (7) years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in business administration, business management, public administration, public management, clinical administration or clinical management of which (B) at least three (3) years must have been in a managerial capacity.
