As a Senior Legal Councel,you will serve as a key member of Alcon China’s Legal team to identify and mitigate legal risks, and to support growth of the Company. The successful candidate will manage legal issues effectively and provide strategic and practical legal advice, guidance and counselling to the business team and other functions with the goals of complying with laws and regulations; manage and implement legal projects/programs (e.g. anti-monopoly program); provide legal support for business development, crisis management (including government investigations) as well as day-to-day support on a wide variety of corporate and commercial issues in a heavily-regulated environment. The position will be based in Shanghai or Beijing and will require some travels throughout China.

In this role, a typical day will include:

  • Deeply understand the business and provide practical and proactive legal advice and supports to business team(s) strategically to ensure compliance with applicable laws and regulations.
  • Support the Head of Legal to review and assess the risk of business models, balancing the strategic goals and the legal risk to achieve the best interest of the Company.
  • Responsible for managing and implementing legal projects/programs, including but not limited to anti-monopoly program, assisting global privacy officer in China privacy program, developing strategic legal training programs.
  • Draft and prepare contract templates for different purposes; draft, review and propose modifications to commercial contracts, agreements, and other legal documents.
  • Proactively participate and support business transactions, strategic alliances, and business development activities.
  • Provide legal supports for responding government / regulators investigation/inquiry, if any.
  • Work collaboratively with business team(s) and other functions to review company activities, including (a) promotional activities and materials, (b) clinical trials, (c) marketing and communications activity, and (d) interaction with third parties such as regulators, customers, to ensure that the activities meet legal requirements and the company’s high standards of conduct.
  • Manage disputes by reviewing background information, providing exposure assessments, and recommending a path to resolve disputes in a manner that best protects the company's interests.
  • Work closely with Compliance team to support compliance programs, e.g. distributor life-cycle management, other anti-corruption programs.
  • Manage outside counsel effectively in order to achieve the best result at a reasonable cost.
  • Assist on other assignment as necessary.

WHAT YOU’LL BRING TO ALCON:

  • Strong understanding of the pertinent laws and regulations (medical device or other healthcare legal experience is a plus, but not required); proven ability to handle work independently and ethically.
  • Experience in preparing, reviewing and enforcing a wide variety of contracts and other legal documents.
  • Willingness to take direction, be flexible and work as part of a team. Detail-oriented self-starter who can handle multiple matters on a timely basis.
  • Solid interpersonal skills and proven ability to communicate complex issues in a clear and succinct manner.
  • Able to learn new things quickly. Well-organized and capable of handling a demanding workload.

Experience:

PRC law qualified Chinese lawyer (PRC Bar Examination passed); 7-10 years legal experiences including at least 5-year working experiences at a top tire law firm; prior in-house experience with a multinational healthcare company for business partner role is not a must but is preferred. Experience of interaction with government authorities is a plus.

Education:

Degree from an accredited law school or reputable institution of higher education.

Languages:

Mandarin and Proficient in English
