The Division of Occupational Licensure (DOL), an agency within the Office of Consumer Affairs and Business Regulation (OCABR), protects consumers by making sure the professionals they hire comply with state licensing laws. DOL oversees 26 boards of registration, which license and regulate more than 500,000 individuals and businesses to practice over 100 trades and professions. DOL also licenses and regulates the Office of Public Safety and Inspections (OPSI), and the Office of Private Occupational Schools.

About the Role:

The First Deputy Commissioner, Chief of Staff, Special Counsel (“First Deputy”) functions as an enabling agent for the Commissioner to carry out the Commissioner’s overall duties and responsibilities in meeting the Agency’s mission. 

The First Deputy participates in the formulation of policy initiatives and policy development and the resolution of identified problematic situations. The First Deputy makes recommendations to the Commissioner concerning policy, proposed legislation and regulations, and legal matters concerning the Agency.

The First Deputy is an integral part of the DOL legal staff and serves as a Special Counsel, working closely with the OCABR & DOL General Counsels to provide legal advice and support to the Commissioner. The First Deputy manages and coordinates all external communications for the DOL, including, but not limited to, legislative and media inquiries. In addition, the First Deputy is responsible for managing and coordinating all legislative and constituent services for the Agency and all activities for student, industry and consumer outreach; logging and tracking constituent issues and legislation that affects the DOL; media relations; drafting, editing, and publishing publications and reports, including press releases; serving as a liaison to OCABR for all media inquiries; tracking and researching legislation; and compiling notes on testimony, and assisting the Commissioner in preparing for any testimony. The First Deputy will also manage special projects as assigned by the Commissioner and/or General Counsel.

The First Deputy is responsible for assisting with all personnel and hiring activities for the Agency. As the primary liaison with OCABR, the First Deputy ensures compliance with policy, develops “Best Practices,” and implements corrective action when needed. The First Deputy assists as a liaison to the OCABR Administrative Services Unit (“ASU”), including Budget, Human Resources, and Accounting and Revenue. 

Additionally, the First Deputy assists in overseeing Agency training and development initiatives. The First Deputy also assists other Deputy Commissioners with challenges and projects. More generally, the First Deputy works across the Agency with all levels of staff to oversee, manage, and implement various initiatives, policies, and directives.

Duties and Responsibilities: (these duties are a general summary and not all inclusive):

  • External Affairs, Legislative, and Constituent Services: Manage and coordinate all external communications for the DOL, including but not limited to, tracking legislation for the DOL, managing constituent services and media relations, editing and publishing all publications and reports for the DOL including press releases. Respond to, and coordinate the response to, media requests and other general requests for information. Collaborate with the General Counsel to oversee all staff member responses to external requests from the media, associations, and/or other state agencies. Maintain liaisons with various private, local, state, and federal agencies and others in order to exchange information and/or resolve problems. Serve as the DOL’s Liaison to OCABR for all media inquiries. Work with Boards and Commissions along with the Commissioner to review all board members and board appointments. Assist with the development and drafting of DOL wide legislation. Attend legislative hearings and take notes on testimony that affects the DOL. Research, log and track legislation and regulations.
  • Provide advice and support to the Commissioner: Provide analysis of proposed or pending legislation, policy or regulations. Assist in the research and drafting of legislative and regulatory changes. Analyze and draft policy statements that impact the DOL. The analysis will include surveying and reviewing statutes and regulations from other jurisdictions. Review and analyze internal metrics to determine areas of improvement and efficiency. Participate and attend intra-agency and interagency meetings to discuss policies that involve cross-jurisdictional questions. Assist the General Counsel with researching and drafting internal policies and protocols as needed to address areas of common concern throughout the Agency. Assist the General Counsel with researching and preparing memoranda regarding difficult or complex policy matters. Assist the General Counsel with coordinating investigative initiatives and coordinate with other local, state, and federal agencies. Provide guidance and support to Agency leadership and staff on pending matters.
  • Policy Development and Implementation: Work directly with the Commissioner, OCABR Undersecretary, and Executive Office of Economic Development (EOED) Chief of Staff on an ongoing basis on policy development and implementation. Responsible for managing Agency policy implementation by working with the Commissioner, Deputy Commissioner(s), and General Counsel. Recommend, execute, and implement OPSI and DOL policy initiatives. Review existing Board regulations to ensure consistency with the Governor’s policy initiatives and with other agencies that may have adjacent or overlapping jurisdiction. Work closely with the Deputy Commissioners and staff and assist in conducting necessary legislative and external stakeholder outreach.
  • Resources, Personnel and Labor Relations: Assist the DOL Assistant General Counsel Labor and Employment Attorney with all personnel matters and hiring activities for the Agency. Work closely with the DOL Labor and Employment Attorney, HR Unit at EOED to discuss and coordinate HR and labor related matters. Works with the HR and Labor Relations and union representatives on labor issues and disputes, including grievances, arbitrations, charges of unfair labor practices, and other complaints. Also responsible for working with managers on day-to-day HR issues.
  • Budget & Planning: Work with the Director of Administration and Finance and Agency legislative liaisons on legislation affecting the budget, trust fund, and appropriation accounts. Work closely with the Budget Unit at OCABR and DOL Chief Operating Officer to create spending plans and budget for staffing needs within DOL.
  • Operational Projects: Assist the Associate Deputy Commissioner of Technology, the Chief Operating Officer and the Deputy Commissioner of Operations with special projects, assessing metrics, providing guidance brought from EOED on expected priorities and keeping projects related to all these matters on target. 

Preferred Knowledge, Skills, and Abilities:

  • Juris Doctor with legal experience, specifically in the area of administrative law. 
  • Experience drafting regulations.
  • Experience working with press and multiple forms of media (social and traditional media).
  • Experience with the legislature and knowledge of the legislative process.
  • Experience crafting communications and marketing materials.
  • Public speaking experience. 
  • Working knowledge of personnel and operational duties as they pertain to a government agency.
  • Minimum of 10-15 years in management and operational experience as a manager that demonstrates growth over time.
  • Experience in dealing directly with the public including both consumers and businesses.
  • Demonstrated ability to interact with others at all levels of the organization and state government including business leaders, and legislators.
  • Ability to plan, organize and manage personnel and budgetary resources to achieve goals and objectives.
  • Organized and self-motivated.
  • Excellent writing and editing skills for communicating to a broad range of people.
  • Thorough knowledge of the principles and practices of management.
  • Thorough knowledge of the legislative and regulatory process.
  • Thorough knowledge of state government and the budget process.
  • Thorough knowledge of DOL, 26 Boards of Registration, and the Office of Private Occupational School Education.
  • Thorough knowledge of policy development and implementation.
  • Experience reviewing and writing legal documents
  • Excellent communication skills, both in oral and written forms, with a broad range of audiences. Should be comfortable interacting with a broad range of audiences.
  • Ability to establish and maintain effective working relationships with supervisor, associates, subordinates, board members and advisory council members, and other agencies.
  • Excellent interpersonal skills.

MINIMUM ENTRANCE REQUIREMENTS:

Applicants must have at least (A) seven (7) years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in business administration, business management, public administration, public management, clinical administration or clinical management of which (B) at least three (3) years must have been in a managerial capacity.
