PURPOSE OF THE POSITION:

Provide 24-hour emergency response to and investigate incidents involving employee injuries or third party injuries and/or property damage. Manage claims resulting from these incidents to minimize corporate loss exposures that may significantly impact corporate results. Develop, recommend and implement strategies for protecting the company’s interests in casualty lawsuits and attorney-represented claims against the company and in pursuing recovery claims for the company’s casualty losses. 

POSITION ACCOUNTABILITIES:

  • Represent the company in employee work-related injury claims with the objective of resolving those claims without attorney involvement
  • Coordinate case handling closely with Disability Management, Health Services and other departments to implement comprehensive medical case management, rehabilitation, and work hardening programs to help injured employees return to gainful employment
  • Identify and preserve evidence from incident investigations to prevent spoliation claims and to secure appropriate facts required to defend any resulting claims
  • Negotiate claim settlements within individual or delegated authority limits. Attend mediations and settlement conferences as the company representative. Prepare settlement release and related documents for approval. Recover money to recoup the company’s losses resulting from incidents involving third-parties
  • Confer on a regular basis with department managers to assess pending claims status and progress in achieving current department objectives and goals
  • Recommend strategies for negotiating and resolving claims
  • Assist and advise outside attorneys retained to represent the company in personal injury and property damage lawsuits brought for, or against, the company
  • Represent the company as a witness or corporate representative in depositions and in court in injury and damage lawsuits
  • Process medical payments for injured employees’ medical providers for work-related injuries.
  • Coordinate with internal CPKC witnesses and CPKC outside attorneys in preparing for and representing the company at trials and other court proceedings

POSITION REQUIREMENTS:

  • High school degree required; college degree preferred
  • Training and experience in the following areas:
  • Working knowledge of U.S. personal injury litigation, with knowledge of the Federal Employer's Liability Act preferred
  • Substantial railroad experience with excellent working knowledge of operating departments, positions and functions, and/or at least two years of claim investigation and negotiation experience
  • Working knowledge of applicable FRA regulations preferred
  • Experience in claims management, incident response and/or claims negotiation
  • Strong interpersonal communication skills
  • Strong written communication skills preferred
  • Significant management of interpersonal relationships; ability to adapt to a variety of decision-making processes and to communicate with a wide range of personality types

Management Conductor Program:

Becoming a qualified conductor or locomotive engineer is the single best way for a management employee to learn the business at CPKC. You may be required to obtain a certification or to maintain your current certification/qualification as a conductor or locomotive engineer.
