Job Summary

NetApp is seeking a Senior Corporate Counsel for Compliance and Data Privacy, EMEA and APAC, to join our award winning legal department. We are at a pivotal time in NetApp’s journey and the successful candidate will be a highly qualified and pioneering lawyer capable of guiding the business through its transformation as the Company develops its next generation data center and Cloud offerings. At a significant moment in the company’s history, the successful candidate will have an opportunity to be embedded in the business and influence the Company’s strategy and results.

 

This position reports directly to the Senior Director, Worldwide Compliance and Employment, and will work closely with the Company’s senior leadership in the following areas: developing programs to enable NetApp to help our customers change the world with data while operating within the scope of applicable laws; advising leaders on regulatory rules relating to NetApp’s business including anticompetition, anti-bribery and corruption, data privacy and governance; investigating allegations of wrongdoing, and enabling NetApp’s values and culture in action.  The successful candidate will work collaboratively with multiple NetApp stakeholders in Legal, HR, Finance, along with our partners and with outside counsel.

Position Overview

As Senior Corporate Counsel, Compliance and Data Privacy for NetApp’s EMEA and APAC regions, you will be an integral part of NetApp’s global Integrity and Compliance Office (“ICO”), helping create and implement compliance programs around the world.  You will serve as a liaison between company attorneys, outside counsel and NetApp employees.  You will also guide NetApp on how manage and protect employee, partner and customer data while complying with the laws of the many jurisdictions in which it does business.  To be successful you must be extremely organized, detail oriented and customer focused; have strong written and verbal communication skills; be successful at building relationships across functions; and thrive in a fast-paced, dynamic high technology environment.

Essential Functions

  • Under the supervision of the Senior Director, Worldwide Employment and Compliance, conduct risk assessments of our business operations in NetApp’s APAC and EMEA regions and create, implement and manage compliance programs and controls in response to those risks.  These will include programs to prevent or mitigate the risk of bribery and corruption, antitrust violations, and policy violations.
  • Conduct and supervise investigations of potential misconduct in EMEA and APAC, ensuring appropriate fact-finding, protection of attorney-client privilege, document retention and recommended findings and action items.
  • Assist other team members with the development and implementation of compliance related policies, including revisions to NetApp’s Code of Conduct, NetApp’s Anti-Bribery and Anti-Corruption Policy, Whistleblower Policy, Gift and Entertainment Policy, Data Privacy policy and other policies.
  • Assist other team members with the development and implementation of compliance related trainings and communications, including regarding new regulatory requirements or existing NetApp policies.
  • Lead a cross-functional team of senior executives who oversee and advise on NetApp’s investigations, compliance controls and compliance programs in the EMEA and APAC regions.
  • Provide guidance to business units on the laws regarding data privacy and governance in the EMEA and APAC regions and assist in the creation, implementation and management of programs and controls to comply with those laws.
  • Serve as Data Protection Officer for NetApp’s German subsidiary.
  • Speak with customers regarding data privacy and governance.
  • Serve on site and regional leadership teams.
  • Serve as regional liaison and provide guidance to experienced team of Global Trade Compliance professionals.
  • Help drive departmental initiatives, including the development of metrics to measure our effectiveness and the use of technologies to increase efficiencies.

Requirements

  • Strong influencing and persuasion skills.
  • Demonstrated client service orientation, excellent interpersonal skills and the ability to work well with a variety of different personalities.
  • Superior verbal and written communication skills – fluency in English required.
  • Must be able to learn quickly, apply legal analysis in a business context, and work independently to identify issues and resolve problems.
  • Demonstrated ability to handle multiple tasks, set appropriate priorities with clients and deliver results in a fast-paced environment.
  • Substantive expertise in anti-bribery and anti-corruption law, antitrust law, global trade compliance issues and data privacy regulations, along with excellent project management skills.
  • A “Get Things Done” mindset and ability to think creatively and devise practical solutions to complex problems.
  • Demonstrated ability to exercise mature and reliable judgment.
  • Good planning and organization skills, incredible attention to detail, ability to handle multiple tasks, ability to manage projects with multiple deliverables over different time horizons and work in a fast-paced, time-sensitive environment.
  • Solid Microsoft Office skills including Word, Excel, PowerPoint, SharePoint and Outlook.
  • Ability to maintain strict confidentiality.
  • Strong relationship building skills.
  • Ability to lead across cross-functional teams.
  • Experience in a multinational b2b or enterprise hardware/software company preferred.  Experience with an organization with a channel sales model preferred.

Education & Experience

  • A minimum of 7 to 10 years of experience in assessing, creating, implementing and managing compliance programs for multi-national companies related to anti-corruption, antitrust, confidential information, or ethics and compliance is required.
  • A minimum of 3 to 5 years of experience advising on data privacy and governance issues strongly preferred.
  • Law degree required.
